NCA will provide the content and services of the website in accordance with these terms.

By accessing and browsing this site, you accept these terms without limitation.

  1. AGREEMENT

You will not use the website for any illegal purpose.

You will not act in a way that causes damage or loss to our reputation, or harms intellectual property owned by us or our affiliates.

You will not use any automated scripts, cookies, “robots” or any illegal strategy to access, copy or change content of the website, or participate in any denial of service attacks upon our servers.

  1. SUBSCRIPTION

Any subscription from NCA grants the Subscriber access to an online service for the specified period of time, paid for in advance.

Under this Agreement, the Subscriber is granted a non-exclusive, revocable, non-transferable subscription to access NCA’s selected products and services over the Internet. Authorized Users must be officially affiliated with the Subscriber.

This subscription entitles the Subscriber and, where applicable, any Authorized Users to:

  1. access selected NCA Online products,
  2. make searches of the subscribed products,
  3. make one hard copy of the output of any search;
  4. share electronic copies to the extent permitted for works protected under the Copyright Act (that is:
    1. all copyright notices must be maintained and visible on all copies
    2. copies may only be made available to other Authorised Users
    3. limited extracts may be quoted will full attribution for the purposes of study or review.)
  5. for Individual subscriptions - access for the Subscriber by desktop and/or one mobile device up to 1,000 downloads in any 12 month period
  6. for organisational subscriptions – access for the Subscriber and up to 7 Authorised Users by desktop and/or up to 7 mobile devices up to 7,000 downloads in any 12 month period
  7. for institutional subscriptions – all current members and/or students of the institution are Authorised Users for up to 20,000 downloads in any 12 month period. Further download rights are available by negotiation.

Organisational and institutional subscriptions require an Administrator, that is, a person who creates an account for the use of the business. The Administrator is bound by these Terms, and is authorised by the business to bind it to these terms. The Administrator for an organisational licence agrees to ensure every user of the products and services understands and agrees to these Terms. The Administrator for an institutional licence agrees to these Terms on behalf of all users and will take all reasonable steps to ensure users do not breach these Terms.

  1. SUBSCRIPTION RENEWALS

If you do not pay for renewal of a subscription within 30 days of notice being sent by NCA, your access will be cancelled.

  1. REFUND/RETURN POLICY

Subject to Clause 13 (Limitation of Liability) refunds will be given only

  • to the original purchaser of the Product only, as shown on the credit card, cheque, purchase order or Paypal account;
  • for products returned at your expense, in good condition, to NCA, PO Box 353, Fairfield Vic 3078 Australia  within thirty (30) days of receipt of the Product.
  1. CANCELLING A SUBSCRIPTION

You may cancel your subscription at any time by

  • selecting the Cancel Subscription button on the screen - further charges will be stopped automatically - or
  • by arrangement with our billing department.
  1. WEBSITE COPYRIGHT

NCA reserves all rights and specifically all intellectual property rights in the website and its content. If you believe a work in copyright has been inadvertently included without due permission, please contact NCA in writing giving details.

  1. NCA SECURITY POLICY

We use our best endeavours to protect all the information you provide us however we are not responsible for unauthorised access to that information.

  1. LIMITATION OF LIABILITY

NCA reviews all content provided on the website and in the Products, but makes no representation or warranty that content or information is complete, up-to-date or appropriate for your purpose.

Information and associated interactions contained in this website and the Products are not intended to be used to diagnose, treat, cure or prevent any disease or for therapeutic purposes. NCA does not accept liability for any injury, loss or damage incurred by any use of, or reliance on the information provided through the website or the Products, whether arising from negligence or otherwise.

NCA does not accept liability for any loss or costs including incidental or consequential damages arising out of your use of the website. In the event that such liability cannot be excluded, NCA limits its liability to, at our option:

  1. in the case of Products:
    • the replacement or repair of the products or supply of equivalent products; or
    • payment of the cost of replacing the Products or acquiring equivalent products.
  1. in the case of any services:
  • supplying the services again; or
  • payment of the cost of having the services supplied again.
  1. INDEMNITY

You agree to indemnify NCA against any claim incurred by NCA, which arises directly from

your breach of these terms, use of the NCA website, your negligence, orany wilful misconduct by you.

  1. LINKED SITES
  • NCA is not responsible for any information contained and accessed through any link provided on the website; and
  • NCA neither guarantees nor endorses products or services linked to the website.

Other websites are welcome to link pages in the website, with NCA’s written permission provided that no attempt is made to pass off the content of the website as the property of the linking website.

  1. GENERAL TERMS

These Terms and Conditions, and your access to the website, are governed by the laws of Victoria and you agree to submit to the exclusive jurisdiction of the courts located within the State of Victoria, Australia for any disputes.

Any dispute with NCA will be resolved first by escalation to senior management and only if that fails by referral to mediation. If a mediator cannot be agreed, the chairman of the Victorian Bar Council will appoint a mediator. The costs of mediation will be shared equally between the parties.

The failure of NCA to exercise or enforce any right or provision of the Terms and Conditions will not constitute a waiver of any such right or provision.

Each clause is severable.

  1. CHANGES TO TERMS AND CONDITIONS

NCA reserves the right to change these Terms by notice posted on the website.

All rights not expressly addressed are reserved.
